By placing an order with Wide World Web Design, you confirm that you are in agreement with and bound by the terms and conditions below. Your contract with Wide World Web Design will be on the conditions specified here to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing.
The Client: The company or individual (over 18 years in age) requesting the services of Wide World Web Design.
Wide World Web Design: Holly Barber.
The client is engaging Wide World Web Design to supply a website (actual specifications to be outlined at the time of placing the order) to be installed on the client's web space located on an Internet Service Provider's (ISP) computer. The client authorizes Wide World Web Design to freely access this ISP account during creation of the site and for any additional amendments and maintenance thereafter.
Domain name registration and web site hosting are at the expense of the client and will be the full responsibility of the client. It is the responsibility of the client to renew their domain name and any web hosting package when due. If a domain name or web hosting service expires Wide World Web Design cannot be held liable for this and will not accept any responsibility for any losses incurred. If a web host's service is unavailable, malfunctioning or interrupted Wide World Web Design cannot be held liable and will not accept any responsibility for any losses incurred.
Wide World Web Design will supply a website based on the specifications and within the agreed timeframe of the client. Upon completion of the project a maximum of two revisions to the draft website will be included at no extra charge. Further revisions will be billed at the standard hourly rate of £30 per hour.
Once the website has been moved to the client's ISP, minor updates and changes to existing web pages will be offered at no additional cost for a period of TWO WEEKS from the completion of the website (subject to a maximum of 1 hour's work per webpage). Repairs resulting from the client making their own changes to the website during this time, however, will not be covered and will be charged at the standard hourly rate of £30 per hour.
At the conclusion of the initial two week period further amendments will be charged at the standard hourly rate of £30 per hour.
Wide World Web Design makes every effort to design pages which display acceptably in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.
All text, images and logos will be supplied by the client and the content of such are the client's responsibility. The client and Wide World Web Design will work together to complete the website in a timely manner and within the timeframe agreed, however, any delay to the completion of the website caused by missed deadlines for the supply of materials by the client will be the responsibility of the client and Wide World Web Design cannot accept any liability for costs incurred.
Any materials required by but not provided by the client, e.g., stock photography, special fonts etc. will be at the expense of the client.
Wide World Web Design will not take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.
The client hereby agrees that any material submitted for publication will not contain anything which may be deemed offensive, illegal or in any way controversial. Wide World Web Design reserves the right to refuse to handle in any way any such material and will not be held liable for any claim resulting from the client's use of such materials.
A non-refundable deposit of fifty percent (50%) of the project fee (to be agreed upon in writing in advance) will be required to commence work on the website.
Upon completion a draft version of the website will be put online for the client's viewing and proofing. During this proofing stage, typographical errors, design changes (up to a maximum of two design changes) and other corrections will be made according to instructions from the client. The full balance payment must be then made before the website can be moved to the client's ISP.
Payment may be made by bank transfer, cheque or credit/debit card
Upon final payment the copyright of the website will be transferred to the client, however rights to photographs, graphics, source code and computer programmes are specifically NOT transferred to the client and remain the property of their respective owners.
Wide World Web Design retains the right to display entire websites, web pages, graphics, and other web design elements as examples of their work in their portfolio and any other promotional material.
The client agrees that a link to the Wide World Web Design website (www.wideworldwebdesign.com) will be included in the footer of their website in the form of an authorship accreditation and that, upon written request by Wide World Web Design, this must be removed.
Wide World Web Design's responsibility is limited to designing client's website and excludes the update, use, altering, maintenance, troubleshooting etc. of the customer's website once online. Following the transfer of the website to the client's ISP, site maintenance and the content of the website will be the full responsibility of the client. Wide World Web Design cannot be held responsible for any failure to maintain a current copy of the client's website or any damage to the website resulting from changes made by the client to their website. Any repairs required to the website following changes made by the client can be undertaken by Wide World Web Design at the client's request and will be billed at £30 per hour.
For a two week period following the transfer of the site to the client's ISP, however, Wide World Web Design will perform minor updates and changes to existing webpages (up to a maximum of 1 hour's work per page) at no additional charge. Should the client require Wide World Web Design to perform maintenance or make amendments after this period any work undertaken will be billed at the standard rate of £30 per hour.
As part of our service Wide World Web Design will include features in your web pages (e.g. pages titles, meta data and keywords) to optimize search engine performance, however we cannot guarantee any specific placement or high ranking on search engines.
To the maximum extent permitted by law Wide World Web Design excludes liability for any loss, claim, damages or any special, consequential, exemplary or punitive damages (whether directly or indirectly incurred) of any kind arising out of or in connection with any visitor's or user's access to, or use of any website created by Wide World Web Design, or any material therein, whether based in contract, tort or whether negligent or otherwise, even if Wide World Web Design has been advised of the possibility of such damage.
Wide World Web Design will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. eg. Any disputes re content/images that have been provided to us for inclusion on the site.
